These Terms of Sale (“Terms”) apply to purchases made through the TOKATI online store (“TOKATI,” “we,” “us,” or “our”).

By placing an order through our website, you agree to these Terms. Please review them carefully before completing your purchase.

1. GENERAL

These Terms apply to all orders, purchases, payments, deliveries, returns, refunds, and other transactions made through the TOKATI online store.

By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method submitted with your order.

If you are under the legal age required to enter into a purchase agreement in your jurisdiction, your purchase must be made with the permission of a parent or legal guardian.

2. PRODUCTS

We make reasonable efforts to display our products, colours, graphics, materials, measurements, and other product details as accurately as possible.

However, colours and appearance may vary slightly depending on your screen, lighting, manufacturing process, fabric characteristics, garment wash, or production batch.

Because some TOKATI products may be produced or printed after an order is placed, minor variations between individual garments may occur.

Product availability is not guaranteed.

3. PRODUCT SIZING

Customers are responsible for reviewing the sizing information provided on the applicable product page before ordering.

Fit may vary between different TOKATI products, garment styles, and collections.

If measurements or a size guide are provided, we recommend reviewing them before completing your purchase.

4. PLACING AN ORDER

To place an order, you may be required to provide information including:

• Your name

• Email address

• Billing information

• Shipping address

• Payment information

After your order is submitted, you may receive an order confirmation by email.

An order confirmation means that we have received your order. It does not necessarily mean that your order has been accepted or entered into production.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

• A product is unavailable;

• Payment cannot be authorized or verified;

• Information provided with the order appears incorrect;

• An order appears fraudulent;

• There has been an obvious pricing, description, or technical error;

• We are unable to fulfill the order;

• The order violates these Terms or applicable law.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

5. MADE-TO-ORDER AND PRINT-ON-DEMAND PRODUCTS

Certain TOKATI products may be produced, printed, packaged, or fulfilled by third-party manufacturing and fulfillment partners after your order is placed.

This means production may begin shortly after your purchase.

Manufacturing and fulfillment times are estimates and may vary depending on product availability, production volume, shipping destination, carrier delays, customs processing, or other circumstances outside our reasonable control.

6. PRICES

Unless otherwise stated, prices displayed on the TOKATI website are shown in the currency indicated at checkout.

Applicable taxes, shipping charges, duties, and other fees may be calculated separately and displayed before your purchase is completed.

We may change product prices at any time.

A price change will not normally affect an order that has already been accepted, except where there has been an obvious pricing or technical error.

7. PAYMENT

Payment must be completed using one of the payment methods available at checkout.

Payment processing may be provided by Shopify Payments or another third-party payment provider.

TOKATI does not control your bank, credit card company, payment processor, or currency-conversion provider and is not responsible for fees they may charge.

Your order may be delayed or cancelled if your payment cannot be successfully authorized.

8. SHIPPING

TOKATI ships orders to eligible destinations shown during checkout.

Available shipping methods, charges, and estimated delivery times will be displayed where applicable.

Our target delivery timeframe is generally up to approximately two weeks, although delivery times are estimates and are not guaranteed.

An order may arrive earlier or later depending on:

• Production time;

• Carrier delays;

• Destination;

• Customs or border processing;

• Weather;

• Holidays;

• Incorrect shipping information;

• Other events outside our reasonable control.

9. SHIPPING ADDRESS

Customers are responsible for providing a complete and accurate shipping address.

Please review your shipping information carefully before completing your purchase.

If an order has already entered production or been shipped, we may not be able to change the delivery address.

TOKATI is not responsible for delays, failed deliveries, or additional shipping expenses resulting from an incorrect or incomplete address provided by the customer.

10. TRACKING

Where tracking is available, tracking information may be provided after an order has been fulfilled or shipped.

Tracking updates are controlled by the applicable shipping carrier and may not always update immediately.

11. SPLIT SHIPMENTS

Products within the same order may occasionally be manufactured or shipped separately.

As a result, you may receive your order in more than one package and at different times.

12. DELIVERY

An order will generally be considered delivered when the shipping carrier records it as successfully delivered to the shipping address provided with the order.

If your tracking information indicates that your order was delivered but you cannot locate it, please first check around the delivery location and contact the applicable carrier.

13. ORDER CHANGES AND CANCELLATIONS

Because some TOKATI products are produced specifically after an order is placed, production may begin quickly.

If you need to change or cancel your order, contact us as soon as possible.

We will make reasonable efforts to accommodate your request, but we cannot guarantee that an order can be changed or cancelled after it has entered production, fulfillment, or shipping.

14. RETURNS

Unless a product is marked as final sale or is otherwise excluded from returns, eligible TOKATI products may be returned within 30 days in accordance with our Return Policy.

Returned products must generally be:

• Unworn;

• Unwashed;

• Undamaged;

• Free from stains, odours, or other signs of use;

• In resalable condition;

• Returned with original tags where applicable.

TOKATI reserves the right to reject a return that does not satisfy the applicable return requirements, subject to your rights under applicable consumer protection laws.

15. RETURN SHIPPING

Unless the product is defective, damaged, incorrect, or otherwise required by applicable law, customers may be responsible for return shipping costs.

Original shipping charges may not be refundable unless required by applicable law or stated otherwise in our Return Policy.

16. DEFECTIVE, DAMAGED, OR INCORRECT PRODUCTS

If you receive a product that is defective, damaged, or materially different from what you ordered, please contact TOKATI as soon as reasonably possible.

We may ask you to provide:

• Your order number;

• A description of the issue;

• Photographs showing the product and the problem.

If we determine that the product is defective, damaged, or incorrect, we may provide an appropriate remedy, which may include a replacement or refund.

Nothing in these Terms limits rights available to you under applicable consumer protection law.

17. REFUNDS

Approved refunds will generally be issued to the original payment method used for the purchase.

Refund processing times may vary depending on the payment provider, financial institution, or credit card company.

After TOKATI issues a refund, your bank or payment provider may require additional time before the refund appears in your account.

18. FINAL SALE PRODUCTS

Certain products may occasionally be designated as Final Sale.

Where permitted by applicable law, final-sale products may not be eligible for change-of-mind returns or exchanges.

Final-sale status will be identified before purchase where applicable.

This does not limit any rights you may have regarding defective, damaged, incorrect, or non-conforming products.

19. PROMOTIONS AND DISCOUNT CODES

Promotional offers and discount codes may be subject to separate conditions.

Unless otherwise stated:

• Promotions cannot be combined;

• Discount codes have no cash value;

• Discounts cannot be applied retroactively;

• Promotions may be changed or discontinued at any time;

• Certain products may be excluded.

TOKATI reserves the right to cancel or reject the use of a promotion where there has been misuse, fraud, or an obvious technical error.

20. GIFT CARDS

If TOKATI offers gift cards, their use may be subject to additional terms presented at the time of purchase.

Gift cards are generally not redeemable for cash except where required by law.

21. INTELLECTUAL PROPERTY

TOKATI product designs, logos, graphics, photographs, branding, website content, product names, and other original materials may be protected by copyright, trademark, and other intellectual property laws.

Purchasing a TOKATI product does not transfer ownership of TOKATI intellectual property or grant permission to commercially reproduce our designs.

22. PERSONAL USE

TOKATI products are primarily offered for personal consumer use.

Large-volume, commercial, fraudulent, or suspicious orders may be reviewed, limited, or cancelled where reasonably necessary.

23. WEBSITE AND PRODUCT INFORMATION

We make reasonable efforts to ensure that information on our website is accurate.

However, occasional errors may occur involving:

• Pricing;

• Product descriptions;

• Images;

• Availability;

• Colours;

• Measurements;

• Promotions;

• Shipping information.

Where an obvious error occurs, we reserve the right to correct the information and, where reasonably necessary, cancel or adjust an affected order.

If an affected order has already been paid and is cancelled, the applicable payment will be refunded.

24. EVENTS OUTSIDE OUR CONTROL

TOKATI will not be responsible for delays or failure to perform obligations caused by events outside our reasonable control.

These may include:

• Carrier disruptions;

• Customs delays;

• Supply shortages;

• Manufacturing interruptions;

• Severe weather;

• Natural disasters;

• Government restrictions;

• Labour disruptions;

• Transportation interruptions;

• Internet or telecommunications failures;

• Other circumstances reasonably outside our control.

We will make reasonable efforts to complete affected orders as soon as practical.

25. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, TOKATI will not be responsible for indirect, incidental, special, or consequential losses arising from a purchase or use of our website or products where such liability may legally be excluded.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Nothing in these Terms is intended to remove or restrict any mandatory rights you have under applicable Canadian consumer protection laws.

26. THIRD-PARTY SERVICES

Our store may use third-party providers for services including:

• Website hosting;

• Payment processing;

• Manufacturing;

• Printing;

• Warehousing;

• Shipping;

TOKATI may update these Terms from time to time.

The Terms applicable to your purchase will generally be the version published on our website at the time you place your order.

30. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
